This forward-thinking volume examines the rule of law from a global perspective, in the context of a growing array of transnational challenges and threats As the United Nations (UN) notes, the rule of law constitutes the basis “on which fair and just societies are built.” The contributions to this volume provide insights to several emerging debates about what the rule of law means in the modern era of warfare and of massive and systematic human rights violations that call for robust and transparent accountability mechanisms and processes. The authors of this work examine several controversial topics, including: -The growing use of drones, and the morality of long distance use -The UN Security Council’s evolving counterterrorism policies and practices -Victims’ Rights and the effort to provide meaning and justice to victims and survivors of terrorism - The relationship between the International Criminal Court (ICC) and Truth and Reconciliation Commissions (TRCs) -The effectiveness of the international criminal justice process overall, with an eye to procedural fairness and justice. This timely work will be of interest to researchers in criminal justice, particularly with a focus on counter-terrorism and international justice, as well as international law, human rights, and international studies.

'UN Secretary-General Ban Ki-moon has called Climate Change 'the defining issue of our era'. It presents international law and lawyers with a wide range of novel issues, practical as well as conceptual. These challenges are addressed in this volume with great authority by many of the leading international law scholars of our generation. It is an important and distinctive contribution to the burgeoning literature on an issue critical for the future of our planet.' – David Freestone, George Washington University, US Climate change will fundamentally affect every area of human endeavour, including the development of international law. This book maps the current and potential impacts of climate change on the norms, principles, rules and processes of international law. This timely study brings together a group of leading scholars in their respective fields of international law to examine the impacts of climate change, and our responses to it, on the whole spectrum of international legal regimes, including those dealing with everything from climate displacement, human rights, and international trade and investment, to the oceans, the environment, armed conflicts and the use of force, and outer-space. the volume also examines the impacts of climate change on the underlying principles and processes of international law including those relating to the making and enforcement of international law and to third party dispute resolution. the book shows that there is much more to dealing with climate change than negotiating one global climate change-specific regime. Other areas of international law can, and must, be included in the solution. In this way international law can maximise its coherence and its efficacy. This well-documented study will appeal to international lawyers, academics, policy makers, government employees, negotiators, practitioners, international legal theorists and anyone interested in climate change and how to maximise our international legal and policy responses to it.

This in-depth book explores the changing role of comparative law in an era of Europeanisation and globalisation. It explains how national law coexists and interacts with supranational and international law and how legal rules are produced by a variety of institutions alongside and beyond the nation-state. The book combines both theoretical and practically oriented contributions in the areas of law and development, comparative constitutional law, as well as comparative private and economic law. It offers a plurality of perspectives on the theory and methods of comparative law as a legal discipline, but also on comparative law when concretely applied in projects of legal aid, harmonisation of law and legal reform. Offering a multi-disciplinary perspective, this book will appeal to researchers and policymakers in international organisations. It will also serve as a valuable resource for advanced level courses on comparative law, and on law reform and legal aid.

Building The Rule Of Law In Haiti written by and has been published by this book supported file pdf, txt, epub, kindle and other format this book has been release on 2009 with Civil rights categories.

The problems with Haiti's criminal laws are clear and have been known for many years. In the past, there have been several failed attempts to reform the criminal laws; however, none of these attempts went very far. According to those who have been involved in those efforts, something is different now and there are great hopes that this current process will be a success. One of the distinctions with this effort is that the law reform process has received high level political support from the president, the prime minister, the parliament, and from within the justice system, the legal community and civil society. International actors as well as Haitian lawyers and politicians have stressed the fact that a comprehensive overhaul of the legal and institutional framework is necessary and is long overdue. In addition to representatives from civil society and the legal community, lawmakers involved in reform efforts are committed to making substantial changes to the law in order to modernize it and to ensure it complies with Haiti's international human rights obligations. The expressed intent of those involved in the criminal law reform process is to work to change the views of the population about the justice system, improve their relationship with it, and crucially, ensure that the justice system serves all the people of Haiti (rather than just the rich and powerful).

In the spring of 1992, Deng Xiaoping made a historical tour of south China, popularly known as the Nanxun (OCOsouthern tourOCO). During the tour, he boldly called for more radical economic reform and further opening up of China. The Nanxun has become a political landmark in the history of the People's Republic of China, much like great events such as the Great Leap Forward, the Cultural Revolution, and the 1989 Tiananmen crackdown. Deng Xiaoping has left his own legacy for the country. The Nanxun belongs to Deng, just as the 1911 revolution belongs to Sun Yat-sen and the communist revolution to Mao Zedong. In this collection of articles, leading China scholars and experts analyze how the Nanxun has sparked off dynamic economic growth in China and drastically changed the political and social landscape of the country. Contents: Economic Growth and Transformation; Social Dynamism and Consequences of Economic Transition; Ideological Decline, Party Decay, and Return to Control?; Legal Reforms and the Search for More Efficient Governance. What Is Law Pdf

BOOK EXCERPT:

In recent years the impact of human rights and fundamental rights on private law has risen in prominence and led to a whole series of detailed investigations. 'Constitutionalization of private law' is the flag under which most of the research on the increasing impact of national constitutional rights on national private legal orders is sailing. In the absence of a European Constitution, the constitutionalization of European private law suggests a process: constitutionalization instead of constituent power, demos, and the magic constitutional moment. The Charter of Fundamental Rights and the European Convention of Human Rights constitute the two pillars on which the transformation of European private law rests. This volume clearly demonstrates the change that has taken place, at the national and at the European level. Private law is no longer immune to the intrusion of fundamental and human rights. Whilst member states and the EU are driving the process by adopting ever more concrete and more comprehensive lists of human and fundamental rights, at the national, the European, and international level with overlapping contents, the true and key players in this development are the national and European courts. Contributions to this volume give this process a face and a direction, which is highlighted in the introduction by Hans-W. Micklitz.
